Terms of Service

1. Acceptance of Terms

Welcome to TakeFive, operated by Tech Trans Lab ("we", "our", or "us"). By downloading, accessing, or using the TakeFive mobile application or website (the "Service"), you agree to be bound by these Terms of Service ("Terms").

If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years old (or 16 in the European Union) to use TakeFive. By using the Service, you represent that you meet the minimum age requirement. If you are under the age of majority in your jurisdiction, you must have consent from a parent or legal guardian.

3. Account Registration

You may register using an email address and password, or via a third-party provider (Apple ID, Google). You are responsible for:

• Providing accurate and complete registration information.
• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.

You agree to notify us immediately at support@techtranslab.com if you suspect unauthorized access to your account.

4. User Content

TakeFive allows you to record, upload, and share video clips, vlogs, and other content ("User Content"). By submitting User Content, you:

• Retain ownership of your User Content.
• Grant TakeFive a non-exclusive, worldwide, royalty-free license to store, process, display, and distribute your User Content solely to operate and improve the Service.
• Represent that you own or have the necessary rights to share the User Content and that it does not infringe any third-party rights.

We do not claim ownership of your content. You may delete your content at any time through the app, and upon account deletion, all your content is permanently erased.

5. Prohibited Conduct

You agree not to use TakeFive to:

• Post or share content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
• Violate any applicable local, national, or international law or regulation.
• Infringe the intellectual property rights of others.
• Harass, bully, or stalk other users.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Introduce malware, viruses, or other harmful code.
• Scrape, crawl, or systematically extract data from the Service without our written consent.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

We reserve the right to suspend or terminate accounts that violate these Terms.

6. Subscription & Billing

TakeFive offers free and paid subscription tiers. Paid subscriptions are billed through the Apple App Store or Google Play Store.

• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
• You can manage or cancel your subscription in your device's App Store / Play Store settings.
• Refunds are governed by the respective platform's refund policy.
• We reserve the right to change subscription pricing with reasonable advance notice.

7. Intellectual Property

All rights, title, and interest in and to the TakeFive Service — including the name "TakeFive", logos, trademarks, software, and proprietary content — are owned by Tech Trans Lab or its licensors. Nothing in these Terms grants you ownership of or a license to use our intellectual property beyond what is necessary to use the Service.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TECH TRANS LAB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Account Deletion

You may permanently delete your account at any time via Settings → Delete Account in the app. Upon deletion:

• All personally identifiable data (profile, credentials, sessions, content, squad memberships) is immediately and irreversibly erased from our active databases.
• Cloud media files are scheduled for permanent deletion within 30 days.
• This action cannot be undone. We are unable to recover deleted accounts.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Taiwan, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Taipei, Taiwan.

12. Open Source Software

TakeFive's video processing engine is built upon FFmpeg and related libraries licensed under the GNU Lesser General Public License v3.0 (LGPL-3.0), including LAME, libass, GNU FriBidi, and FreeType. Other components are licensed under MIT, BSD, Apache-2.0, and similar permissive licenses.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When changes are material, we will provide at least 14 days' notice via the app or by email before the new Terms take effect. Your continued use of the Service after the effective date constitutes acceptance.
